Privacy Policy

Amivae LLC (“Amivae,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you visit joinamivae.com, contact us, or use the Amivae mobile application and related services (collectively, the “Services”). Some app features described below may become available only when the mobile application launches.

1. Information We Collect

Account and profile information. We may collect your name, email address, login or authentication information, profile settings, preferences, and other information you provide to create or maintain an account.

Date of birth and eligibility information. Amivae is intended only for adults age 18 or older. We collect your full date of birth to verify eligibility. If the date of birth you provide shows that you are under 18, you are not eligible to create or use an Amivae account.

Wellness and body information. Depending on the features you choose to use, you may provide height, weight, weight history, body measurements, wellness goals, calorie or macronutrient goals, hydration goals and logs, movement or activity goals and logs, daily reflections, and other wellness information. Goals are selected by you; Amivae does not prescribe calorie targets, weight-loss plans, or clinical dietary recommendations based on your body details.

Nutrition and food information. We may collect foods and meals you log, calories and macronutrients, serving quantities, meal history or timing, dietary preferences and restrictions, saved or recent foods or meals, food-search queries, barcodes you scan, and food photos you choose to submit for logging or analysis.

Apple Health information. If you choose to connect Amivae with the Apple Health app through Apple’s HealthKit framework and grant permission, Amivae may access step count and relevant activity or movement information. Amivae does not currently obtain your weight from Apple Health. Connecting Apple Health is optional, and you control the permissions you grant through Apple.

Personalization and app-use information. We may collect or generate information relating to onboarding selections, how you want to feel, selected goals, dietary preferences, Today’s Plan selections, Daily Focus interactions, Evening Reflection responses, Personal Coaching interactions, feature preferences, display or palette choices, and other settings or interactions used to personalize your experience.

Technical, diagnostic, and usage information. We and service providers that help operate Amivae may collect device type, operating system, app version, IP address, crash and diagnostic data, log data, security information, and information about how features are used. Where consent is required or Amivae offers a privacy choice for a particular form of analytics, we will honor that choice.

Subscription and transaction information. If you purchase a subscription through Apple, we may receive subscription status, product information, transaction identifiers, and purchase-validation or entitlement information. Apple processes App Store payments; Amivae does not receive your full payment-card number from Apple.

Communications and support information. If you contact us, we may collect your name, email address, the contents of your message, and any information or attachments you voluntarily provide.

2. How We Use Information

We use information to provide, secure, personalize, maintain, troubleshoot, and improve the Services; create and manage accounts; verify age and eligibility; provide nutrition, hydration, movement, food-logging, wellness-tracking, insights, reflections, and related features; process and verify subscriptions; respond to support requests; prevent fraud, misuse, and security incidents; comply with legal obligations; and enforce our agreements.

We do not use information obtained from Apple Health for advertising, marketing, or use-based data mining, and we do not sell personal health or wellness information.

3. Optional Food Search, Barcode, Photo, and AI Services

Some optional features rely on external data sources or processors. Food-name searches may query food databases such as USDA FoodData Central or Open Food Facts. Barcode lookup may query a food database using the barcode you scan. If you affirmatively choose an AI-enabled photo-analysis feature, the selected meal photo may be sent to the third-party AI service provider used for that feature so that it can suggest foods or estimated nutrition.

When these features are used, Amivae is designed to send the information reasonably necessary for the requested feature—for example, the search term, barcode, or selected photo—rather than your full wellness history unless the feature clearly requires otherwise. Before personal information is shared with a third-party AI provider, Amivae will provide the disclosure and obtain the permission required by applicable law and platform requirements.

4. How We Disclose Information

We may disclose information to service providers that perform functions for Amivae, such as cloud hosting and database storage, authentication, analytics and crash reporting, AI-enabled functionality, food or barcode data services, photo processing or analysis, subscription management, customer support, communications, and security. These providers may process information as necessary to provide services to Amivae and are subject to applicable contractual and legal obligations.

We may also disclose information when reasonably necessary to comply with law or legal process, protect the rights, safety, or security of Amivae or others, investigate fraud or misuse, or in connection with a merger, financing, acquisition, reorganization, or sale of assets, subject to applicable law.

We do not disclose Apple Health information to advertising platforms or data brokers, and we do not use it for targeted advertising.

5. Apple Health

Amivae requests access only to Apple Health data types reasonably necessary for enabled features. Health-data permissions are controlled through Apple and may be declined or revoked at any time. Information obtained through Apple Health using HealthKit is used to provide health and fitness functionality to you and is handled in accordance with applicable Apple requirements.

6. Storage, Retention, and Security

Amivae may store information both on your device and in cloud-based systems used to operate your account and the Services. We retain information for as long as reasonably necessary to provide the Services, maintain legitimate business and security records, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods may vary by data type and purpose.

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.

7. Your Choices and Rights

You may choose whether to provide many optional wellness and body inputs, whether to connect Apple Health, whether to use photo analysis or other optional third-party features, and how you configure available privacy and display settings. Apple Health permissions can be changed through Apple.

You may request access, correction, or deletion of personal information, or request deletion of your Amivae account, by contacting support@joinamivae.com. We may need to verify your identity before completing a request. Certain information may be retained where required or permitted by law, including for security, fraud prevention, dispute resolution, or legal compliance.

Depending on where you live, applicable law may provide additional privacy rights. We will honor applicable rights as required by law.

8. Adults Only

Amivae is intended only for individuals age 18 or older. We do not knowingly provide accounts to minors. If we learn that we have collected personal information from a person under 18 in connection with an Amivae account, we will take appropriate steps consistent with applicable law.

9. Health and Wellness Information

Amivae is a consumer wellness service and is not a healthcare provider or medical device. Wellness, nutrition, weight, body-measurement, activity, and related information may be sensitive. Amivae’s handling of such information is also subject to applicable privacy, security, and breach-notification requirements.

10. Health Breach Notification

Where the Federal Trade Commission’s Health Breach Notification Rule or another applicable breach-notification law applies, Amivae will provide required notices in accordance with that law. This may include notice to affected individuals, government authorities, and, where legally required, the media.

11. Third-Party Services and Links

The Services may interact with third-party services, including Apple and providers supporting Amivae. Those third parties may have their own terms and privacy practices. Amivae is not responsible for third-party services that you access independently of Amivae.

12. Changes to This Policy

We may update this Privacy Policy as Amivae develops or our practices or legal obligations change. We will post the updated policy with a revised effective date and provide additional notice when required by law.
